Accretive is a big hedge fund that “owned” Axiant and Mann Bracken (which I believe is actually one and the same, Axiant being a shell company in my opinion). NCO Financial (part of NCO Group) has had it share of Federal lawsuits against them for FDCPA, FCRA and other violations . Now that they own even more of the debt collection industry I am betting the consumer abuse will only get worse. There are as many reasons for hacking as there are hackers . Personality traits of a hacker It’s hard to pin down just a few personality traits that define a hacker. A typical hacker profile is a male, age 14 to 40, with above-average intelligence, obsessively inquisitive with regards to technology, non-conformist, introverted, and with broad intellectual interests. A hacker is driven to learn everything he can about any subject that interests him. In fact, most hackers that excel with technology also have proficiency in no technological hobbies or interests. Hackers tend to devour information, hoarding it away for some future time when a random bit of technical trivia may help them solve an intriguing problem. Hackers seem especially fond of complex intellectual challenges and will move on to a new project once the challenge and novelty wears off. Personality traits of a cracker Contrast this with the following cracker/script kiddy profile and you start to get an idea of why hackers resent being lumped in with crackers. The average cracker or script kiddy (in the United States) is a 14- to 28-year old white male, usually intelligent but academically underachieving, who lives in his parents’ basement and collects comic books (OK, I added those last two). Cultural and behavioral distinctions between groups can help identify a cracker because they often leave clues when they deface a Web site or break into a computer. Crackers and script kiddies differ from ethical hackers. They often lack social skills, are loners (most hackers I know love company), and show poor judgment and impulse control. Where a hacker may work for days or weeks to solve a particularly difficult problem, a script kiddy lacks the discipline to even begin to become a competent programmer and so depends on code written by real hackers. Financial gain motivates some crackers. Credit card and bank fraud present opportunities to use cracking to increase personal wealth. Cracker/script kiddy culture sees stealing from large corporations as a kind of Robin Hood game. While major financial crimes involving crackers are not commonplace, there have been instances of theft on a grand scale by the more talented among them. In 1994, a Russian computer programmer stole millions of dollars from Citibank accounts. The cracker, Vladimir Levin, was part of a group that created a complicated scheme of wire transfers and pickup all over the world.

Class Action Lawsuit Filed Against NAF, Mann Bracken, Accretive and Others

NEW YORK, NY — (Marketwire) — 09/15/09 — The law firm of Milberg LLP has filed a class action lawsuit in the United States District Court for the Central District of California on behalf of all persons who used NAF’s arbitration services during the period from June 1, 2006 to the present, inclusive (the “Class Period”). The complaint is available from the Court or can be viewed at Milberg LLP’s website at www.milberg.com . Until recently, NAF held itself out as a leading forum for consumer arbitrations, which is how many consumer debt disputes are resolved. An arbitration forum must above all be impartial, so that consumers can be confident that their disputes with creditors (e.g., banks, credit card companies, phone companies, etc.) will be heard fairly, as would be the case if the dispute was resolved by a court of law. The class action lawsuit filed against NAF and related parties alleges that NAF has misled consumers for years in this regard because it was owned by and/or beholden to a debt collection agency and debt collection law firm, such that in reality it was a debt collector, not a neutral forum for resolving disputes by the debt collection industry against consumers. The result of these alliances was near perfect success rates by debt collectors against consumers in NAF arbitrations. More specifically, the complaint alleges that NAF, National Arbitration Forum, LLC (“NAF LLC”), Mann Bracken, LLP (“Mann Bracken”), Accretive LLC (“Accretive”), Agora Fund I GP, LLC, Axiant, LLC, and Forthright Solutions (collectively “Defendants”), falsely held NAF out to be independent and unaffiliated with any persons or entities within or outside the collections industry and falsely presented its arbitration services as neutral. According to the complaint, Mann Bracken is a law firm that claims to specialize in consumer debt collection matters, but is a debt collector in its own right. NAF and Mann Bracken are both owned by Defendant Accretive who owns and controls both NAF and Mann Bracken, and their related entities. According to the complaint, NAF is now “under siege by local and state prosecutors for working alongside creditors, rubber-stamping illegitimate arbitration awards against consumers, deceiving the courts and the public, and undermining the integrity of the arbitration system.” The complaint specifically alleges that NAF maintained a near perfect success rate — ruling in favor of business entities — by engaging in improper, deceptive and corrupt acts, including: (a) establishing incentives for arbitrators to favor debt collectors over consumers; (b) disregarding consumers’ evidence and/or arguments; (c) overlooking and violating its own Code of Procedure to benefit debt collectors, and ultimately, large creditors; (d) disregarding creditors’ lack of evidence; and (e) failing to provide the bona fide arbitration services it promised to consumers. The complaint also alleges that NAF breached its contractual obligation to provide arbitration services to consumers, and that NAF directly benefitted from, and was unjustly enriched by the contractual breaches. The ILOVEYOU virus surfaced on the 4th of May 2000. By the 13th of May some 50 million systems had been infected at a cost estimated to be in the region of $5.5 billion. During a period of just 5 hours the virus spread across Asia, Europe and the United States via email messages that came with the title, “ILOVEYOU.” ILOVEYOU spread so quickly that corporate IT managers ended up shutting down their email systems and entire Web servers became clogged. This virus was received via an email with the subject line, “I Love You”, which carried an attachment named, “Love-Letter-For-You.txt.vbs.” As I’m sure you are all aware, opening attachments in emails you know nothing about is not a good idea. A great many people, however, did just that and so they became infected. When the ILOVEYOU virus managed to infiltrate a system it would scan the machine’s memory, looking for passwords. These were then sent back to the virus creator’s website in the Philippines which was soon shut down after the outbreak occurred. It would also corrupt any files it found that ended with .vbs, .vbe, .js, .css, .wsh, .sct, .hta, .jpg, .jpeg, .mp2, .mp3 by overwriting them with a copy of itself. The ILOVEYOU virus would then replicate and send itself to anyone listed in the Outlook address book of the infected machine. National Health Care Reform – A Convoluted Prostitution of our Constitutional Rights

I am one of the nations uninsured. Back in November 2008 my wife broke her foot, the healing process was quite long (about 6 months). We paid out of pocket for the physicians care, x-rays and the walking cast boots she had to wear. Being uninsured we found that everyone we dealt with gave us a very nice cash discount for not using insurance. What a blessing that was. For the last two years my family has lived below the national poverty line. Things are tough. Both my wife and I are self-employed and we felt the economy going downhill nearly three years ago. In fact last year my wife closed her business (hair salon) and went to work for another salon. Closing the salon got rid of a huge amount of overhead. However, our combined income dropped because consumers were spending less and doing without. So far June and July has been the worst for us than we can ever remember in the past. We are just barely squeaking by, if you can even call it getting by. More like doing without many, many things. The main point of this is, I and my family cannot afford to buy insurance, nor do we want to have someone decide for us. It’s either pay our house payment, food and utilities or purchase health insurance. I bet you can guess where our money goes. If I don’t buy insurance, according to H.R. 3200 ( 1,017 page Bill in PDF format ) I could be penalized. Hey congress, just exactly where are you going to get money from me if I don’t? Are you going to force me to default on my home in order to pay, or are you going to garnish my bank account (then I can’t pay my bills or buy food for my family). Just exactly what are you (Congressional) idiots thinking? Congress can’t even (or won’t) fix Medicare or Social Security. Try fixing the things that are broken before you legislate more things that you will break and can’t fix. Put that in your pocket for a while and think about it. I don’t want anyone to dictate how, when or where I and my family get healthcare. I am a citizen of the United States and I have a freedom of choice. It doesn’t matter how much honey and perfume you pour over this bill, it still stinks as bad or worse than the TARP bailout from earlier this year.

Hopefully with the true nature and operation of Accretive Technologies being exposed and publicized perhaps regulators, enforcement and law makers will take swift action. Slowly but surely opaque layers are being peeled away and exposing just who and what are behind the National Arbitration Forum (NAF) and several national debt collection law firms. Namely Mann Bracken LLC / LLP, Wolpoff and Abramson and Eskanos and Adler. All of which are “owned” by Axiant, which is in turned owned by a hedge fund, Accretive Technologies, which in turned it owned/run by one man. His name is J. Michael Cline.

Then I went and deposited the Draft with FEDEX COURIER SERVICE, West Africa, I travelled out of the country for a 3 Months Course and I will not come back till end of December. What you have to do now is to contact the FEDEX COURIER SERVICE as soon as possible to know when they will deliver your package to you because of the expiring date. For your information, I have paid for the delivering Charge, Insurance premium and Clearance Certificate Fee of the Cheque showing that it is not a Drug Money or meant to sponsor Terrorist attack in your Country. I remember that a Major Fadi Basem left me a huge amount of money last year after being killed in Iraq. Having spent it all, I was delighted to hear from Hang Seng Bank again, through this email that says I have another inheritance to collect – Good Day, Let me start by introducing myself. I am Mr. Patrick K.W. Chan (Executive Director and Chief Financial Officer) of the Hang Seng Bank Ltd. I have an obscured business suggestion for you. Before the U.S and Iraqi war our client Gen. Abbas Radhi Ismail who was with the Iraqi forces and also businessman made a numbered fixed deposit for 18 calendar months, with a value of (Twenty Four million Five Hundred Thousand United State Dollars only) in my branch. Upon maturity several notices was sent to him, even during the war which began in 2003. Again after the war has subsided, another notification was sent and still no response came from him.
