Acer Passes DELL in Computer Shipments – Dell is Now Number 3 – DELL Sells Poor Quality Computers

You want to know the real reason why Dell is shipping less computers? It’s because of the poor quality of their computers and consumers are spreading the word. That and Acer as well as other computer manufacturers make better quality PC’s. At one point a good many years ago DELL made great, near trouble-free personal computers. In the last coup0le of years the DELL’s quality has suffered and I am assuming it is due to trying boost profits, rather than ship good computers. I as a consumer have had many problems with the quality and workmanship of Dell Pc’s, workstations and servers. I go out of my way to encourage other consumers to buy *anything* except Dell computers. Recently I had a “go around” with DELL over bad computer board components that I and clients had experienced. DELL said that weren’t going to do anything about it. Fine with me, this just gives me even more incentive to spread the word about the cheap and shoddy computers DELL sells. What DELL doesn’t realize is that I own and operate quite a few websites, that reach, conservatively speaking, roughly 450,000 unique visitors each month. On each website I have a big warning banner to discourage consumers from buying DELL products. I imagine that consumers that read the articles attached to the warning banners tell other consumers, and those consumers tell other consumers, so on and so forth. While DELL may not want to do anything about my own (and my clients) computer problems, at least I know I can reach millions of consumers every year and expose DELL’s poor quality computers.

Beware of calls from 206-337-9266 – Big Money ATM Scammers

I hate automated messages left on my answering machine. Last night I received a call from 206-337-9266 asking me if I needed money now. The message left by the scammers smelled all too much like a typical get rich quick scam. In the message they left a domain name (Big Money ATM .Com – i put spaces in it to prevent accidently hyperlinking). I pulled the domain registration for the domain and of course it is a private registration that hides the owners true identity. If the caller and owner were legitimate the domain “who is” record would display the actual owners. the scammers use GoDaddy registration and hosting services. It figures. Most of the email scams and robo-caller phone scams I see or hear all point back to GoDaddy.com hosting and domain registration services. If you get a call from 206-337-9266, report them to the Federal Trade Commission ( www.ftc.gov ). Maybe one day GoDaddy will actually enforce their terms of service and boot scammers like this.

Inside ARM takes exception to my reward for proof of illegal debt collection policies

Inside ARM, a magazine dedicated to the debt collection industry, and in my opinion a mouthpiece for ACA International, the lobbying “organ” (insert your own joke here) for the collection industry to congress, has taken exception that I and my “small” magazine are offering cash rewards for written/documentable proof that collection agencies have policies that authorize and encourage illegal debt collection. Mr. Patrick Lunsford is referring to my article entitled, “Debt Collection Employees – looking for Debt Collection Policies that prove Illegal Collections”, which you can read here . I look at it this way, if I hadn’t been subjected to abusive collection tactics (and many, many other consumers as well) there would be no need for myself to write such an article and offer cash for proof of abusive (documentable) collection policies. In addition, I have been approached by many consumers offering to add cash to the bounty for proof of abuse (there are more of us than there of them). The Federal Trade Commission (FTC) and Congress itself has long turned a blind eye to rouge debt collectors and illegal collection tactics. It is time for consumers to go on the offensive and put a stop to it. I for one will gladly layout my hard earned money to prove that more than a minority of the collection industry actively engage in abusive and illegal debt collection tactics. It’s time to name and shame them all, embarrass Congress, the FTC and the entire U.S. Justice system until strong measures are put in place to monetarily discourage abusive debt collection practices. A small town business and lifestyle magazine is currently running a solicitation looking for debt collectors, or former debt collectors, to come forward with official documentation detailing illegal company policies. In other words, they are trying to find written proof that collection agencies encourage their employees to break the law. And they’re offering a cash reward. It’s just a small indicator of what faces the ARM industry in the media throughout the rest of the year, and going forward. News outlets have figured out that the “debt collectors = evil people” paradigm is stale and needs updating. I think that the solicitation is the opening salvo in a reenergized attack on the industry.”

And they were right because as more people lose their jobs all branches of the military are finding it easier to meet recruitment goals. Source: MSNBC The tough job market is making some jobs a lot easier. As the economy goes down, military recruitment goes up. Its a sellers market, as one Marine recruiter put it, and thats with military action in Iraq and Afghanistan. For a change, the Army doesnt have to go out as much to try to attract recruits because more and more are walking through the door. One recruiting officer noticed that theyre a little older than the norm. About 27, 38, 36 years old, all the way up to almost 40, said Sgt. Jermaine Martin. President Obamas plan to increase the military by 100000 is now possible as military service becomes the job of last resort. Obamas defense department is even recruiting soldiers from what they call temporary immigrants, to give them a shot at citizenship. Using waivers for high school graduation and criminal convictions the Pentagon hopes to recruit 1000 into the US Armed Forces this year.

Debt Collectors Will Pay More Than $1 Million to Settle FTC Charges – Credit Bureau Collection Services

Another unethical debt collector gets smacked by the Federal Trade Commission — A nationwide debt collector has agreed to pay a civil fine of more than $1 million to settle Federal Trade Commission charges that it violated federal law by inaccurately reporting credit information and pressing consumers to pay debts they often did not owe. According to the FTC’s complaint, the company and two of its officers illegally tried to collect invalid debts and reported them to the credit reporting agencies without noting that consumers disputed them. In addition, even after receiving information from consumers that a debt was paid off or did not belong to the consumer, the company continued to assert, no longer with a reasonable basis, that the consumer owed the debt, without trying to confirm or dispute the consumer’s information, in violation of the FTC Act. The FTC charged that the company, Credit Bureau Collection Services, and two of its officers, Larry Ebert and Brian Striker, violated the FTC Act and the Fair Debt Collection Practices Act. The company also is charged with violating the Fair Credit Reporting Act by reporting information to credit agencies that consumers had proved was inaccurate, failing to inform to the credit agencies that consumers had disputed the debts, and failing to investigate after receiving a notice of dispute from a credit reporting agency. In addition to imposing the $1.1 million civil penalty on the company, the settlement order: Bars the defendants from further violations; Prohibits them from making unsupported statements to collect a debt or obtain information about a consumer; Bars them from making claims that a debt is owed or about the amount, without a reasonable basis; Requires the defendants, when a debt is questionable or a consumer questions it, to either close the account and end collection efforts or investigate the dispute. If they cannot show that the consumer owes a debt, they cannot sell the debt or provide it to any business other than the original client; and Bars the company from re-reporting information to credit reporting agencies that it had voluntarily deleted from credit reporting before December 2008. The Commission vote to authorize staff to refer the complaint and consent decree to the Department of Justice for filing was 4-0. The documents were filed in the U.S. District Court for the Southern District of Ohio, Eastern Division. The Commission recently released a video for consumers who are facing debt collection . The video is at www.ftc.gov/MoneyMatters , a site that includes information for consumers on managing credit, dealing with debt, and a variety of other financial topics. NOTE: The Commission authorizes the filing of a complaint when it has “reason to believe” that the law has been or is being violated, and it appears to the Commission that a proceeding is in the public interest. The complaint is not a finding or ruling that the defendants have actually violated the law. Consent decrees are for settlement purposes only and do not necessarily constitute an admission by the defendant of a law violation. Consent decrees are subject to court approval and have the force of law when signed by the judge. The Federal Trade Commission works for consumers to prevent fraudulent, deceptive, and unfair business practices and to provide information to help spot, stop, and avoid them. Payment Processing CEO Banned from the Business; Company Illegally Debited Millions from Consumers’ Bank Accounts

The chief executive officer of a payment processing company will be banned from the business as part of a settlement resolving Federal Trade Commission charges that the company illegally debited millions of dollars in bogus charges from consumers’ bank accounts. In 2007, the FTC charged the executive, Tarzenea Dixon, her company, and others with processing unauthorized debits on behalf of deceptive telemarketers and Internet-based schemes they knew, or deliberately avoided knowing, were violating the FTC’s Telemarketing Sales Rule. In addition, the attorneys general of Illinois, Iowa, Nevada, North Carolina, North Dakota, Ohio, and Vermont charged the defendants with violating various state laws. According to the FTC complaint, the company played a critical role in helping many of its clients carry out these illegal schemes by providing access to the banking system and the means to extract money from consumers’ bank accounts. Between June 23, 2004, and March 31, 2006, the defendants processed more than $200 million in debits and attempted debits. More than $69 million of the attempted debits were returned or rejected by consumers or their banks for various reasons, an indication that in many cases consumers had never authorized the charges. In many instances, the merchants either failed to deliver the promised products or services or sent consumers relatively worthless items. The settling defendant is Tarzenea Dixon. Her co-defendants are Your Money Access, LLC d/b/a Netchex Corp., Universal Payment Solutions, Check Recovery Systems, Nterglobal Payment Solutions, and Subscription Services, Ltd.; YMA Company, LLC; and Derrelle Janey. In addition to permanently banning Dixon from any payment processing, the settlement order bans her from substantially aiding any marketer when she knows, or consciously avoids knowing, that it is violating the Telemarketing Sales Rule. The order imposes a $22 million judgment that is stayed based on her inability to pay. The full judgment will become due immediately if she is found to have misrepresented her financial condition. The Commission vote approving the consent in settlement of the court action against Dixon was 4-0. The FTC filed the documents in the U.S. District Court for the Eastern District of Pennsylvania on December 22, 2009, and court entered the order on January 11, 2010. Litigation against Janey continues. On October 28, 2008, the court entered a default judgment against the corporate defendants, Your Money Access, LLC and YMA Company, LLC, barring them from payment processing for any client whose business practices are deceptive, unfair, or abusive within the meaning of the FTC Act, the Telemarketing Sales Rule, and the state consumer protection laws. The case was part of the FTC’s “Operation Tele-PHONEY” telemarketing fraud law enforcement sweep announced in May 2008. Wachovia Bank Redress Program In December 2008, the FTC announced a settlement between the Office of the Comptroller of the Currency and Wachovia Bank, N.A. to issue more than $150 million in redress checks to victims of telemarketing fraud. The checks reimbursed consumers for funds deducted from their accounts by three payment processors that maintained accounts with Wachovia, including Your Money Access. NOTE: Stipulated final judgments and orders are for settlement purposes only and do not constitute an admission by the defendants of a law violation. Consent judgments have the force of law when signed by the judge. The Federal Trade Commission works for consumers to prevent fraudulent, deceptive, and unfair business practices and to provide information to help spot, stop, and avoid them.
