Business Opportunity Con Artist Surrenders Million-Dollar Las Vegas Home

After trying for years to keep assets he acquired while deceiving consumers with false promotions and bogus business opportunity pitches, a repeat offender has agreed to turn over his Las Vegas home, valued at over $1 million, and give up his appeal of the Federal Trade Commission’s case against him. The settlement announced today wraps up the FTC’s case against Richard C. Neiswonger, who twice has been held in contempt of court at the FTC’s request – first, for deceptively marketing business opportunities in violation of an earlier court order, and second, for failing to turn over assets to pay a multi-million-dollar judgment against him. In April 2007, a federal district court held Neiswonger, his business partner William S. Reed, and their firm, Asset Protection Group, Inc., in civil contempt for violating a 1997 court order that prohibited them from deceptively promoting business opportunities and failing to disclose material facts to consumers. The court banned Neiswonger from selling business opportunities to consumers and telemarketing. The court also entered a $3.2 million judgment against him – the amount of his ill-gotten gains – and required him to transfer the title of his Las Vegas home to a court-appointed receiver within 20 days if he failed to pay the judgment in full. Neiswonger never made the payment, and in September 2009, at the FTC’s request, the district court held him in contempt for a second time and ordered him to turn over the title to the house or face jail time. The court found that he had failed to deliver a marketable title to his home. Under the final settlement order, Neiswonger will surrender the house in Las Vegas, valued at more than $1 million. The order requires his wife, Shannon Neiswonger, and any other people living in the house to move out and turn it over for sale by a court-appointed receiver. It also requires the Neiswongers to dismiss all related appeals and release any claims they may have against the receiver or the FTC, and it directs the receiver to sell the house to help pay the judgment. The FTC previously obtained Neiswonger’s $379,000 retirement account to help pay the judgment as well. As part of the settlement, Shannon Neiswonger, who was not a defendant in the FTC action, will be paid $100,000 from the proceeds of the sale of the house, which she owned jointly with Richard Neiswonger. Twitter Settles Charges that it Failed to Protect Consumers’ Personal Information

Social networking service Twitter has agreed to settle Federal Trade Commission charges that it deceived consumers and put their privacy at risk by failing to safeguard their personal information, marking the 30th case the FTC has brought targeting faulty data security, and the agency’s first such case against a social networking service. The FTC’s complaint against Twitter charges that serious lapses in the company’s data security allowed hackers to obtain administrative control of Twitter, including access to tweets that consumers had designated private, and the ability to send out phony tweets pretending to be from then-President-elect Barack Obama and Fox News, among others. “When a company promises consumers that their personal information is secure, it must live up to that promise,” said David Vladeck, Director of the FTC’s Bureau of Consumer Protection. “Likewise, a company that allows consumers to designate their information as private must use reasonable security to uphold such designations. Consumers who use social networking sites may choose to share some information with others, but they still have a right to expect that their personal information will be kept private and secure.” Twitter allows users to send “tweets” – brief messages of 140 characters or less – to “followers” who sign up to receive such messages via e-mail or phone text. Twitter offers privacy settings through which a user may choose to designate tweets as nonpublic. For instance, users can send “direct messages” to a specified follower such that only the specific author and recipient can view such a message. Twitter users can also click a button labeled “Protect my tweets,” which makes that user’s tweets private so that only approved followers can view them. The privacy policy posted on Twitter’s website stated that “Twitter is very concerned about safeguarding the confidentiality of your personally identifiable information. We employ administrative, physical, and electronic measures designed to protect your information from unauthorized access.” According to the FTC’s complaint, between January and May 2009, hackers who gained administrative control of Twitter were able to view nonpublic user information, gain access to direct messages and protected tweets, and reset any user’s password and send authorized tweets from any user account. In January 2009, a hacker used an automated password-guessing tool to gain administrative control of Twitter, after submitting thousands of guesses into Twitter’s login webpage. The administrative password was a weak, lower case, common dictionary word. Using the password, the hacker reset numerous user passwords and posted some of them on a website, where other people could access them. Using these fraudulently reset passwords, other intruders sent phony tweets from approximately nine user accounts. One tweet was sent from the account of then-President-elect Barack Obama, offering his more than 150,000 followers a chance to win $500 in free gasoline. At least one other phony tweet was sent from the account of Fox News. During a second security breach, in April 2009, a hacker compromised a Twitter employee’s personal e-mail account where two passwords similar to the employee’s Twitter administrative password were stored, in plain text. Using this information, the hacker was able to guess the employee’s Twitter administrative password. The hacker reset at least one Twitter user’s password, and could access private user information and tweets for any Twitter users. According to the FTC’s complaint, Twitter was vulnerable to these attacks because it failed to take reasonable steps to prevent unauthorized administrative control of its system, including: requiring employees to use hard-to-guess administrative passwords that are not used for other programs, websites, or networks; prohibiting employees from storing administrative passwords in plain text within their personal e-mail accounts; suspending or disabling administrative passwords after a reasonable number of unsuccessful login attempts; providing an administrative login webpage that is made known only to authorized persons and is separate from the login page for users; enforcing periodic changes of administrative passwords by, for example, setting them to expire every 90 days; restricting access to administrative controls to employees whose jobs required it; and imposing other reasonable restrictions on administrative access, such as by restricting access to specified IP addresses. Under the terms of the settlement, Twitter will be barred for 20 years from misleading consumers about the extent to which it maintains and protects the security, privacy, and confidentiality of nonpublic consumer information, including the measures it takes to prevent authorized access to information and honor the privacy choices made by consumers. The company also must establish and maintain a comprehensive information security program, which will be assessed by a third party every other year for 10 years. The Commission vote to accept the proposed consent agreement was 5-0. The FTC will publish an announcement regarding the agreement in the Federal Register shortly. The agreement will be subject to public comment for 30 days, beginning today and continuing through July 26, 2010, after which the Commission will decide whether to make it final. Comments should be addressed to the FTC, Office of the Secretary, Room H-135, 600 Pennsylvania Avenue, N.W., Washington, D.C. 20580. The FTC is requesting that any comment filed in paper form near the end of the public comment period be sent by courier or overnight service, if possible, because U.S. postal mail in the Washington area and at the Commission is subject to delay due to heightened security precautions. NOTE: The Commission issues an administrative complaint when it has “reason to believe” that the law has been or is being violated, and it appears to the Commission that a proceeding is in the public interest. When the Commission issues a consent order on a final basis, it carries the force of law with respect to future actions. Each violation of such an order may result in a civil penalty of up to $16,000. The Federal Trade Commission works for consumers to prevent fraudulent, deceptive, and unfair business practices and to provide information to help spot, stop, and avoid them. If you are a person that is on the internet a lot then there is a good chance that you have heard of a technology called BitTorrent . You might not know what it does exactly but you have probably seen the name on some of the news sites that you visit. It has been a very controversial technology for a while now and, while its notoriety has been spreading, the software has been becoming ever more popular. While the technology itself, like all other technology, can be used for good and bad purposes by the average user, it is all of the sudden becoming a popular tool in the malware community. In the following article I will tell you what the technology does and why it is being used to spread malware around to unsuspecting computer users. BitTorrent And File Sharing Bittorrent is the name of the software and the protocol that allows you to share files quickly over the internet. Back in the day, you had to us a normal HTTP format to share files. The files would go from one location straight to the next place. With BitTorrent the file is split up and it is intended to be shared by a group of people. This way the file does not have to be downloaded completely by one person for him to share it with another person – they will just get the piece that he downloaded from someone else. There can be one or more seeders (people who have the original file) and a bunch of other people get the pieces from them. They get it piece by piece instead of all at the same time. With this system the file transfer goes quicker and everyone is able to get the most out of the bandwidth that is available. This technology is used for both legal and illegal file sharing which is the exact reason why it has been on the news lately. Spreading Malware Like any other technology, since it is becoming so popular, the bad guys are starting to use it more and more to deliver their malware. There have always been bad guys on the BitTorrent circuit but now there are more than ever. With certain attacks, they change the name of the files so that it confuses you and you download the wrong thing. They also hide the malware in illegally obtained software in the form of keygens or the executable itself. There have even been cases where they hide the malware in .pdf files . There are a lot of web sites that use BitTorrent to share their legal files so the technology is not going away anytime soon. This means that if you want to use the technology to get a file that you want you are going to have to take some precautions. There are certain precautions that you can take and they are the same precautions that you should employ any other time you download an unknown file from the internet. You must have an updated antivirus scanner and run it over everything that you download from BitTorrent sites – I would guess that maybe 99% of the items will come up clean but it is that other 1% that you have to worry about. When a person first starts out in the world of being a cyber security expert, they have a different impression then they will have leaving the job. Their impressions are like most people and it is understandable. We get our ideas about hackers, and the threat that a computer contains, from Hollywood movies. They teach you that super smart hackers are able to infiltrate your system in little to no time at all. They also show that all attacks come from the other side of the planet by either some Russian or Chinese kid. Security Breaches Often Come From The Inside In reality, that is only a small portion of the problem when it comes to a company’s network security being breached. Usually the culprit can be found to be someone who either works there or has been fired recently. Basically if you have ever seen the movie Office Space then you will have a pretty good idea of how most cyber security breaches happen. In the movie a disgruntled employee and a couple of his friends find a way to be able to steal money from the company by using a piece of software that they wrote. This is how a great deal of breaches happen, yet people are mostly focused on protecting the network from users on the outside. This is very short sighted and can have dangerous consequences. Dealing With Internal Threats If you are an IT administrator, or the company’s security expert , then you must realize that you will need to have policies regulating the threat from inside of the network. There’s needs to be a hierarchy so that only the people who need a piece of information can access it. Not everyone that works at a company needs to have the power to access every file. Also third party USB thumb drives and DVD disks should not be allowed on the system. This is the perfect way to be able to infect a computer that is on the network (see the Conficker virus ) . If these types of portable media are allowed, they need to be heavily regulated. The problems that can occur from one of these devices is astronomical. Of course guarding your network from threats that are outside of the network is vital in keeping a happy and secured work place. Keeping that vector of attack safe is a full time job within itself. But if you are not protecting your network from threats that are inside of it, then you are not doing your job. Never give your workers 100% complete faith when they are working behind the network. Inside ARM takes exception to my reward for proof of illegal debt collection policies

Inside ARM, a magazine dedicated to the debt collection industry, and in my opinion a mouthpiece for ACA International, the lobbying “organ” (insert your own joke here) for the collection industry to congress, has taken exception that I and my “small” magazine are offering cash rewards for written/documentable proof that collection agencies have policies that authorize and encourage illegal debt collection. Mr. Patrick Lunsford is referring to my article entitled, “Debt Collection Employees – looking for Debt Collection Policies that prove Illegal Collections”, which you can read here . I look at it this way, if I hadn’t been subjected to abusive collection tactics (and many, many other consumers as well) there would be no need for myself to write such an article and offer cash for proof of abusive (documentable) collection policies. In addition, I have been approached by many consumers offering to add cash to the bounty for proof of abuse (there are more of us than there of them). The Federal Trade Commission (FTC) and Congress itself has long turned a blind eye to rouge debt collectors and illegal collection tactics. It is time for consumers to go on the offensive and put a stop to it. I for one will gladly layout my hard earned money to prove that more than a minority of the collection industry actively engage in abusive and illegal debt collection tactics. It’s time to name and shame them all, embarrass Congress, the FTC and the entire U.S. Justice system until strong measures are put in place to monetarily discourage abusive debt collection practices. A small town business and lifestyle magazine is currently running a solicitation looking for debt collectors, or former debt collectors, to come forward with official documentation detailing illegal company policies. In other words, they are trying to find written proof that collection agencies encourage their employees to break the law. And they’re offering a cash reward. It’s just a small indicator of what faces the ARM industry in the media throughout the rest of the year, and going forward. News outlets have figured out that the “debt collectors = evil people” paradigm is stale and needs updating. I think that the solicitation is the opening salvo in a reenergized attack on the industry.”

Twitter Being Used To Get Information About Potential Targets

This is a great time in social media technology. Even though MySpace and some of the other leaders in the field have fallen by the way side, they have been replaced by either technically or socially superior offerings. Twitter & Facebook In the case of technical superiority, the winner is definitely Facebook and it’s huge user base. It allows you to stay connected to individuals and still maintain a great deal of privacy. Some of that has been changed in the past couple of months, but overall they keep your privacy better than any other social media site. Twitter is the other winner in this battle. They have grown a great deal in such a short amount of time. Unfortunately their privacy policy is not as good as Facebook’s. Private Twitter Twitter allows you to have two settings. Your tweets can either be open or they can be private. When they are private, only the people that you choose are allowed to follow you. This seems secured on the outside, but it quickly becomes a setting that people get tired of. Part of the fun of Twitter, is that people that you do not know get to follow you, if you seem like an interesting person. Locking your twitter account eliminates that feature. So most people end up turning it off. This is when the problems begin. Public Twitter People use twitter when they are in the office, on the streets, and at home. This causes the average user to become real comfortable with the service and maybe say things that they didn’t mean to. This includes personal items about themselves and information about their job that should not be spoken about in public. There are ways that you can delete the offending tweet, but most times it will still be picked up by third party devices that hook to twitter. Applications such as tweetdeck will cache the tweet and the people who follow you will still see it. If a hacker or any other kind of criminal is casing a particular target, they can find out who works there. Once they find out who works there, it should be easy to find the workers that use Twitter . Once that information is found out, they can then set those people as part of a list and monitor what they say. Someone in that group will say something valuable about their job. All they need is one person to slip up. Corporations and small businesses need to go over with their workers social media protocol. A firm policy is needed, so they know what they can disclose on social media sites. The companies must realize that these sites have become a huge way that people socialize and they need to plan for it. I wouldn’t go as far as monitor their tweets but an official office policy should be good enough. Especially when you are dealing with sensitive information. The Threat Of Cloud Computing To Your Company’s Infrastructure

The ideal of Cloud computing has been around for several decades. Only recently has the technology allowed for it to become a reality for practical use. Everyday more and more companies are bringing their sensitive data onto the cloud. This has proven to be a good strategy for corporations to use because of the flexibility that it provides. The ability to be able to quickly update their web resources while at the same time having automated back up capabilities is just the thing that the doctor ordered. But there is a flaw in this type of web hosting that researchers are just now discovering. Cloud Computing Management The first flaw that occurs is more of a management flaw and less of a technical one. If you are business that has their operation hosted on the cloud your hardware will not be hosted in house or in a facility that you control. It will be in the hands of another company that is in a remote location. This leaves you as the customer still responsible for what happens to your data. You must keep a sharp eye out on your cloud provider to make sure that they are keeping your company’s data safe and secure. If you have customers of your own and their data is compromised, blaming your provider will only go so far in their eyes. Technical Flaws There are also several technical flaws that can happen when you host your data on the cloud. Researchers have recently discovered a serious bug that could prove to be a big problem. The problem is that when you have cloud computers on a multi cored server running virtual machines the lack of privacy through the cache on the system is great. When you have a multi cored system the data is transacted back and forth between the cores. This is how the computer processes the data simultaneously so that it can do multiple task at the same time. This is why it is so hard for programmers to adapt to parallel computing. You have to be able to create software without the program running into what is known as a dead lock. When the computer is running the process the data is stored in temporary memory, also known as a cache. Attackers and researchers have figured out ways that they can use this information to able to poison a virtual machine running on the same physical server. Since all of the cores share data that is coming through the cache, poisoned data can be sent to another virtual machine this way. You need to a flashplayer enabled browser to view this YouTube video You can also spy on another company’s virtual machine in this same manner. If this knowledge is made into a workable tool, the possibility for abuse is endless. Even though Cloud computing is becoming more and more popular the technology behind it still has some flaws that it needs to address. When it comes to cloud computing privacy was not the first thing on the mind of the people who implemented it. There are tools that are being released to help alleviate this problem but as of right now the possibility of a serious security breach still exist.
