Think Twice Before Buying a Dell Computer – They Use Shoddy Motherboard Components

At first I thought what I am sharing with you was a single isolated incident, after the third discovery of the same issue with Dell motherboards, in three different models I decided that it is time to disclose Dell’s use of cheap and/or shoddy electronic components. The first incident I discovered in one of our PowerEdge 4600 hosting servers. The server in question is worth more than the card I drive. A year or so ago one of the four hot-swap power supplies began to cause errors and subsequently the server would randomly shut down. This affected many of our customers financially. After babysitting the server for several days, I pulled the malfunctioning power supply out and let the server run on the remaining three. The server stopped shutting down and for the time being I forgot about the issue. About 9 months later (3 months ago) another power supply started causing the same problems. The server again would randomly shutdown. I shut the server down and pulled it all apart and discovered the power distribution board than controls the four power supplies had swollen and leaking capacitors as you can clearly see below. I did manage to talk to Dell Support on a Saturday morning and they gave me the part number(s) for the power distribution board. I called Dell parts the following Monday and they did not stock the part, I was told that it would have to be manufactured (?) and the couldn’t tell me when a board would be available. I couldn’t wait indefinitely for a board from Dell so I ended up getting the board from a Dell equipment surplus company. I got the board in three days and after installing haven’t had any further problems with the server. Shortly after that a customer brought me a high-end Dell XPS tower PC that would not startup. After troubleshooting the power supply I started looking at the motherboard. Initially I saw no immediate problems with the board. However, upon removing the fan shroud from the processors I discovered swollen and leaking capacitors on the motherboard. Dell XPS motherboards are extremely difficult to match as the only documentation I can find are “generation” notations (gen 1, gen 2, etc.). I am still trying to match the motherboard so I can buy a surplus board to install. Next my Dell Precision 650 workstation began randomly shutting down, often times while I was in the middle of working. I pull the system offline and opened it up. I am guess by now you know what I found. Once again I found leaking and swollen capacitors. By this time I am seeing a pattern of shoddy/cheap/defective electrical components on system critical boards. The above are three different computer system that were manufactured in different years and yet have the same identical problem. I have never seen leaking and swollen capacitors in this many computer of the same brand in all my 16 plus years of performing computer repairs. The only thing that can cause this sort of problem is that Dell is buying cheap components for their motherboards in an effort to boost their profit margins on the computers they sell. To top it off one of my family members has a Dell XPS laptop and the motherboard has been replaced four times by Dell to date. I am not positive it’s a capacitor issue but you can bet I believe it may be. I encourage you the next time you shop for a computer stay away from Dell computers. Take a look at Acer, HP and Gateway computers. You’ll be better off if you do.

I just discovered that Google Scholar now has State and Federal Law, including citations, opinions and decisions. What’s even better there are no fees involved. When searching select “Legal opinions and journals”, it yields better legal research results. Google Scholar is a great starting point for consumers defending themselves in court on credit card debt lawsuits, not to mention Pro Se litigants such as myself that sue debt collectors over FDCPA and FCRA violations. The common consumer now has access to legal opinions and decisions that can be used in court filings. I’ve also found it invaluable for seeing what bad debt collection companies are being sued for, this makes it easier for me to file stronger cases against them I encourage anyone that is researching legal issues to give Google Scholar a try before spending money on other online resources. You may just find what you are looking for without having to spend a dime. If you are defending yourself in court against debt collection lawyers and don’t know what to do, you need to get this book, Stick It To Sue Sue Happy Debt Collectors , It shows you exactly how to defend yourself and win, and how to sue debt collectors for harassing you.

Today is the Day to Start Asking Your Dealing With Debt Collector Lawsuit Questions

FYI, today and tomorrow I am answering questions regarding how to deal with debt collectors, debt lawsuits and related topics on my book’s Facebook fan page (discussions). If this works well I may do more question and answer sessions each month. Here is the first question posted today Question: In your book, you state that you must answer the summons in order to file a Motion to Dismiss and sworn denial. Makes sense, but what I’m unsure of is the timing for filing the Motion to Dismiss and sworn denial. Do I file these with the clerk of court at the same time I file my answer or sometime later? Answer: In most states you can file a motion to dismiss (and the sworn denial) as soon as you answer the summons. You should be able to file it at the same time you file your answer with the court. You would need to file them at the court clerks office, make sure you have 3 notarized copies. One for the court, one you must send to the plaintiff’s attorney and one for your files. You may also need to write up a verification (that it was sent) and include it with the papers you file with the clerk and include a copy in the papers you send to the opposing attorney. You may want to check your local court rules and your states “Trial Rules” which are sometimes called Rule of Civil Procedure” to see if there is a rule regarding pleadings and motion time-frame to file). Stick It To Sue Happy Debt Collectors Book – A Clarification of an Affirmative Defense

A reader emailed me and asked what portion of the FDCPA governs the collection of fees, such as attorney fees, outside of the original credit card agreement or amended terms in regards to an affirmative defense that I discuss in my book. In my book “ Stick It To Sue Happy Debt Collectors ”, I omitted a detail on the explanation of an affirmative defense. 18. Plaintiff is barred under the Fair Debt Collection Practices Act, from collecting attorney fees, interest, collection fees, and any amount not specifically provided for by purported agreement. In the affirmative defense explanation of #18 I should have noted that it is a violation of the FDCPA for a debt collector under: 15 USC 1692f § 808.1 Unfair practices A debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section: (1) The collection of any amount (including any interest, fee, charge, or expense incidental to the principal obligation) unless such amount is expressly authorized by the agreement creating the debt or permitted by law. Many debt collection attorneys (especially in “no show” default judgments) will try to collect as much money they can for “attorney fees” and at times attempt to add other costs to a judgment. It is very important that a consumer use the affirmative defenses as outline in the book to prevent greedy lawyers (and Plaintiffs) from getting more than they deserve in the case they actually prove everything (unlikely in 90% of cases) and win a judgment. Consumers many times never respond (1 out of ten respond) to a debt lawsuit for whatever reason. A debt lawsuit is a civil action (they can’t put you in jail for it) and is mostly paperwork. Most of these types of lawsuits are nothing more than a scare tactic to get you to pay or to get a judgment to make you pay. I say make them prove it, if they can’t, you win. This is a preemptive affirmative defense to protect the defendant. If the attorney does collect more than allowed under the original card agreement (even under a default judgment) they may be in violation of the FDCPA. I would assume (my opinion) that if a debt collector files a lawsuit for more than the original amount owed and the interest rate, it could be construed as a false statement and a fraudulent collection practice under the Fair Debt Collection Practices Act (FDCPA). see section 808.1 of the FDPCA (PDF file) . You may be able to sue, even after the fact. A consumer protection attorney could advise you on how to proceed if this does happen. Solomon & Solomon P.C, Julie Farina, and Douglas Fisher 09-1247-cv United States Court of Appeals For the Second Circuit on 01/13/10 Affirmed the verdict of the district court which held that the defendants violated the FDCPA by serving Ellis with a summons and complaint during the FDCPA thirty-day validation period, without explaining that commencement of the lawsuit did not affect the rights set forth in the validation notice. We agree, and hold that service of process during the validation period must , at a minimum, be preceded or accompanied by notice to the consumer clarifying that the lawsuit does not in any alter the information contained in the validation notice. The National Association of Retail Collection Attorneys filed a amicus brief in support of the collection lawyers but it didn’t do any good. Judge said there is real potential for confusion when a consumer is served with a lawsuit during the validation period. Without some explanation to the consumer of the relationship between the suit and the provisions in the notice it may well appear to the least sophisticated consumer that being taken to court trumps any other out of court rights she had. If you want to get people interested in something that you have to say, just add a celebritie’s name to it and the heads will turn. This does not necessarily reflect well on our society, but it is the truth. We pay attention more to celebrities, than to anybody else. It doesn’t matter if they are in movies, music or sports, people care what they have to say. Since this fact is well known, hackers use this to their advantage on a regular basis. Before, they would wait until a big news story about a celebrity to break, and they would then try to capitalize off of it. Since there are sites such as Twitter and Facebook out now, it is easier to create a fake story themselves and get everyone to click on it. Fake Deaths Spread Malware This is exactly what happened last week. Throughout the different social media web sites, it was reported that the actor Johnny Depp, was killed in a car accident . Even though there was no credible source, that was reported in the news,  the story spread like wild fire. In less than a couple of hours, Twitter was filled with RIP notices to the supposed “late” actor’s death. Of course none of this was true and was only just the means of a hacker spreading his latest attack throughout the Internet. It seems that it was a pretty successful attack, even though there are no hard numbers to reveal this fact. But as popular as this fakes new story was throughout the weekend, there had to be a lot of victims to this attack. He used the news, that there was video that showed the actual crash, to spread the virus around. When they went to watch the video, it would ask them to download a codec to be able to see the video. Once they did, the virus would then spread onto their machines. There must be an effort to educate people on what to click and what not to click. If there is not, then attacks such as this will work every time. Malware Plugged In People are so used to web sites asking them to install plugins when they go to them, that it is not a big deal for the average user anymore. When you go to web sites such as CNN.com, they even ask you to use a special plugin to view their content, which is only a Flash video. So it is hard for the average user to be able to tell the difference. As long as these attacks still work, Hackers will do their best to implement them. We have to get the word out to the public, when it is best to install something from a web site. If not, then this problem will be a continuous cycle. Hope For Haiti Program – Did it really need to be on 26 TV channels at the same time?

Last night the wife and I settled into our normal Friday evening routine of watching television. Unfortunately Hope for Haiti was on 26 channels and the same time. While I do admire the fact that the television networks were trying to reach out to viewers in an effort to help with the Haiti disaster, I can’t help but think that there was some sort of monetary gain for the networks as the show ran on (at last count) 26 different channels at the same time. Why else would so many networks run the same exact show? It makes me wonder now much of a “cut” each TV network got from the donations. The show was even on Comedy Central which almost never runs anything of that nature. I am afraid that in running the same program on many channels had more of a backlash effect than a positive effect for the Hope for Haiti. My wife and I after watching the same thing on
